Delayed Diagnosis

Delayed Diagnosis Lawyer in Miami

When the Right Diagnosis Came Too Late, We Take the Case to Verdict

A delayed diagnosis is not the same as no diagnosis at all. In these cases, a provider eventually identified the condition, but the delay itself caused the harm. Treatment options narrowed. The disease progressed. A prognosis that was once manageable became far more serious. That gap between when a diagnosis should have happened and when it actually did is where the legal claim lives.

Kurzban Kurzban Tetzeli & Pratt has handled medical malpractice litigation in Miami, across Florida, and nationwide for over 40 years. Our delayed diagnosis lawyer in Miami builds these cases from the ground up, working with medical professionals to pinpoint where the process failed and what that failure cost the patient.

If a delayed diagnosis caused unnecessary pain, additional treatment, or a worsened prognosis, a Miami medical malpractice lawyer is ready to fight for you. Call (786) 788-8557 or contact Kurzban Kurzban Tetzeli & Pratt today.

How Diagnostic Delays Happen

A delayed diagnosis rarely has a single cause. It most often results from a chain of missed steps or breakdowns in communication, and understanding where the process went wrong is central to building a valid claim.

Common causes of misdiagnoses include:

  • Failure to order appropriate tests: Imaging, biopsies, or bloodwork that would have identified the condition were not ordered or were ordered too late.
  • Mishandled test results: Results were misinterpreted, lost, or never communicated to the treating provider.
  • Failure to refer: The patient was not sent to a relevant physician when symptoms indicated that a referral was warranted.
  • Dismissed or underweighted symptoms: The patient reported warning signs that were minimized or ignored during examination.
  • Communication breakdowns: Coordination failures between treating providers, labs, and consulting physicians allowed critical findings to fall through the cracks.
  • Incomplete medical history: Failure to gather a thorough patient or family history led to missed context for a correct diagnosis.
  • Secondary condition overlooked: A provider correctly identified one condition but failed to recognize a second condition presenting at the same time.

These failures can occur in hospitals, emergency rooms, urgent care centers, private physician offices, and diagnostic labs. The setting matters less than whether a reasonably competent provider, under similar circumstances, would have acted differently.

How Kurzban Kurzban Tetzeli & Pratt Handles Delayed Diagnosis Cases in Miami

We don’t settle cases for less than they’re worth because a trial feels risky. Our attorneys have won cases across the country, and we prepare every claim as if it will go before a jury. That preparation can drive fair outcomes.

A Record Built in the Courtroom

Our record reflects that commitment. We secured a $5.7 million jury verdict for a 37-year-old truck driver whose case illustrates exactly what a delayed diagnosis can cost a patient. Three urologists missed obvious signs of treatable kidney disease. By the time the diagnosis arrived, he had lost both kidneys and required a transplant. The jury found all three providers liable. We have also won what was, at the time, the largest medical malpractice verdict in Florida history.

Recognized Delayed Diagnosis Attorneys, Thorough Case Preparation

Jed Kurzban, our founding attorney and the author of How Justice Is Served, has been selected to the Super Lawyers list and carries an AV Preeminent® rating from Martindale-Hubbell. We build every case with the support of respected medical professionals, financial analysts, and life-care planners. Their analysis documents not only what the delay caused, but what the patient may need going forward, including future care costs, lost earning capacity, and quality-of-life damages.

Conditions Frequently Diagnosed Too Late

Delayed diagnosis claims arise across a wide range of conditions. Some of the most serious include:

  • Cancer: Breast, lung, colon, and skin cancers are among the most commonly delayed diagnoses. Early detection can mean the difference between curative treatment and palliative care.
  • Heart attack: Cardiac symptoms are frequently attributed to indigestion or anxiety, delaying time-critical intervention.
  • Stroke: Stroke presentations can be mistaken for migraine, vertigo, or other conditions, causing providers to miss the narrow window for treatments such as tPA (tissue plasminogen activator, a clot-dissolving medication).
  • Sepsis: Serious infections can escalate to life-threatening complications when not identified and treated promptly.
  • Pulmonary embolism and aortic dissection: Both conditions can present with symptoms that overlap with more common, less urgent diagnoses.
  • Meningitis and autoimmune diseases: Conditions with varied symptom profiles that are sometimes attributed to other causes before a correct diagnosis is reached.

Proving a Delayed Diagnosis Malpractice Claim in Florida

Not every diagnostic delay is actionable. Florida medical malpractice law requires proof of four distinct elements. A claim that can’t satisfy all four, supported by medical testimony, won’t survive.

Duty of Care

The claim begins by establishing that a doctor-patient relationship existed at the time of the alleged failure. That relationship is the foundation for a legal duty to exercise reasonable care in the diagnostic process.

Breach of the Medical Standard of Care

Breach means the provider failed to act as a reasonably competent provider would under similar circumstances. In delayed diagnosis cases, that could mean failing to order indicated tests, ignoring reported symptoms, or not referring the patient to a relevant physician when the situation called for it. We conduct comprehensive medical record reviews and work with respected medical professionals to reconstruct the diagnostic timeline and identify where the standard of care wasn’t met.

Causation

This is often the most contested element. The plaintiff must show that the delay, not merely the underlying condition, caused measurable harm. A worsened prognosis, narrowed treatment options, additional procedures, or a shorter life expectancy can all constitute that harm. Florida law generally requires that causation be established through medical testimony. Defendants commonly argue the condition would have progressed regardless; our approach is to document, with evidence, what earlier diagnosis might have changed.

Damages

Damages must be actual and measurable. They can include additional medical costs and future care expenses resulting from the delay, lost wages and diminished earning capacity, physical pain and emotional distress, loss of quality of life, and wrongful death damages for surviving family members. Florida courts may also award punitive damages where provider conduct rose to the level of gross negligence, though such awards are uncommon.

Florida’s Statute of Limitations for Medical Malpractice

Florida law generally gives patients two years from the date they discovered, or reasonably should have discovered, an injury caused by malpractice to file a claim. A separate four-year statute of repose runs from the date of the negligent act. Unlike the two-year discovery rule, this is generally a hard cutoff on filing regardless of when the harm was discovered. In cases involving fraud or concealment by the healthcare provider, that outer limit can extend to a maximum of seven years from the date of the incident.

Delayed diagnosis cases carry particular timing risk. Patients may not learn the true extent of the harm until well after the original diagnostic failure, putting them closer to the repose deadline than they realize. There is also a mandatory pre-suit investigation requirement under Florida law: Before filing a lawsuit, the plaintiff must obtain a corroborating opinion from a medical professional and serve formal notice on the defendant healthcare providers. That process takes time, and starting it close to the deadline can leave insufficient room to complete the required steps.

Minors and individuals who were incapacitated at the time of the negligent act may have different limitation periods under Florida law. For example, the four-year statute of repose generally doesn’t bar a claim filed on behalf of a minor before the child’s eighth birthday. The only way to know where your claim stands is to have an attorney review the specific facts and timeline as early as possible.
