Driver crashes through three yards, hitting fences and sunbather

On Behalf of | Oct 17, 2013 | Car Accidents |

According to neighbors and authorities, a Florida woman drove her Mercedes-Benz through three residential yards, crashed into fences and struck a neighbor out sunbathing before her car came to rest against her own house. The sunbather was listed in serious condition after being taken to a nearby Medical Center. Later, her condition grew worse, and she was down-graded to critical condition.

The driver sustained minor injuries and was also brought to the medical center. According to the Fire Rescue, the woman might have had trouble making a turn and then overcompensated, causing her to crash into the yards and fences. Neighbors say that the driver has been involved in previous car accidents on her block and that she is a nurse who works long hours.

The sunbather that was critically injured may be facing a long recovery and may not be able to return to work for a period of weeks or months. During that time, medical bills and personal expenses may accumulate. A Florida personal injury attorney might be able to secure a substantial settlement to pay for medical care and lost wages.

If the case is clear-cut, the attorney might negotiate with the at-fault driver’s insurance company. If the insurance company agrees that the driver was clearly to blame for the incident, it may quickly pay a fair settlement to the injured person.

There are some situations in which the attorney might suggest taking the case before a jury in civil court. If the insurance company refuses to pay, the fault is not clear-cut or the plaintiff wishes to seek punitive damages, the attorney might advise that they pursue a civil court trial. If the case made by the attorney is convincing, the jury may find in favor of the plaintiff.
