Pedestrian accident kills one, injures another

A mother and daughter on their way to a Florida synagogue were struck by an automobile in the evening hours of Sept. 13. The daughter was taken to a hospital with severe injuries, and the mother was pronounced dead at the scene. Officials state that the two were hit by a Toyota heading south while they were crossing the intersection of San Jose Boulevard and Haley Road.

The driver was taken into custody at the accident scene. Police are continuing to investigate whether alcohol was a factor in the accident. There is also a possibility that the driver ran a red light. The family may decide to file a wrongful death lawsuit in connection with the accident.

A Florida personal injury attorney may be helpful to family members who choose to seek compensation for the loss of a loved one. The first step an attorney might take would be to review the accident report and determine the family's needs. For example, family members may be entitled to compensation to cover medical and funeral expenses, plus the estimated income that an individual would have earned during their lifetime.

The attorney might negotiate with the driver's insurance company for a fair settlement. If the insurance company chooses to fight paying a settlement, the attorney may suggest taking the case to court. In some cases, insurance companies may refuse to pay compensation.

In court, the attorney may present evidence collected from police reports, photos and eyewitness testimony. The jury may review all the evidence and decide to award damages to the plaintiffs.
