Florida women sues state and contractors for wrongful death

After a man lost his life in an accident in Florida in 2009, his wife told newspapers that she believed the construction in the area where he died was to blame. She later would file a wrongful death suit against the state Department of Transportation and several construction companies working on Interstate 75 near Naples, Florida.

The fatal accident occurred while the man driving down the highway that had been under construction. He lost control of the vehicle after driving over some uneven pavement. His car swerved and when he tried to regain control, he over-corrected and hit some steel cables. The impact of the crash caused his SUV to flip.

Emergency responders at the scene immediately rushed him to the hospital. However his injuries were too severe and he did not survive.

His wife believes that the accident could have been prevented if the state and several contractors had done their job to ensure the safety of drivers in the construction area. There had been reports of several accidents that had occurred in the same area before the fatal crash.

The state and the contractors should have been aware of those incidents and taken that as an indication that additional warning signs should be placed where drivers could see them. This, the wife claims, was negligence that created an unsafe work zone.

By filing a wrongful death claim, the family hopes to receive compensation for expenses related to the funeral, medical care and lost wages. But no amount of money could ever bring back their loved one; it can only help the family move forward with their lives.
